The much-anticipated comic book adaptation Watchmen may never make it into theaters if 20th Century Fox succeeds in a lawsuit against Warner Bros. over movie rights.
A judge has refused Warners' motion to dismiss Fox's lawsuit, which was filed in February. Fox claims it owns the rights to the 1986-87 comic book series, written by Alan Moore and illustrated by Dave Gibbons. The series was later republished in a trade paperback format the film's preview calls "the most celebrated graphic novel of all time."
If Fox wins, it could be awarded part of the profits from the film. But Variety reports that Fox doesn't want the money — it wants to keep the big-budget film from being released at all.
That would be a massive letdown to fans who've already gasped at the film's dark, atmospheric trailer, a first look at Dr. Manhattan, The Comedian, Rorschach, and Silk Spectre. A full-sized replica of Nite Owl's ship was one of the main attractions at Comic-Con in July.
The film, helmed by 300 director Zack Snyder and starring Patrick Wilson, Billy Crudup, and Jackie Earle Haley, is scheduled for release on March 6.
Federal Judge Gary Allen Feess believes Fox retained distribution rights to the graphic novel through a 1991 claim. He also appears to agree that under a 1994 deal with producer Larry Gordon, Gordon acquired an option to acquire Fox’s interest in Watchmen but never exercised it, which left Fox with the rights.
Warners said in a statement that the company does not believe Fox has any rights to Watchmen.
The court has asked the two parties to move quickly to answer evidence requests, a process that can normally take up to two years. The judge wants to move fast because the film has already wrapped.
Fox spent more than $1 million developing Watchmen but has never before taken legal action to halt the project. It was also in development at Paramount years ago.
